COMPLAIN
COUNT I- EVICTION
Plaintiff, RONALD N. LARSON, sues Defendants, JOSHUA ANDERSON and COURTNEY CURRY, and
alleges:
1 This is an action to evict tenant from real property located in Charlotte County, Florida.
2. Plaintiff owns certain real property located in Charlotte County, Florida, consisting of a residence
located at 18415 Arapahoe Circle, Port Charlotte, Florida.
3 Defendant has possession of the property under a lease agreement to pay rent of $1,300.00 per
month beginning on May 15, 2020. A copy of the Lease is attached hereto as Exhibit "A".
4 Defendants have failed to timely vacate said property upon expiration of lease.
5 Plaintiff served Defendants with a Notice to Pay Rent or Deliver Possession, but Defendants
refused to vacate. A copy of the Notice is attached hereto as Exhibit "B".
WHEREFORE, Plaintiff demands judgment for possession of the property against Defendants and costs.
COUNT I - ACTION FOR RENT
Plaintiff, RONALD N. LARSON, sues Defendants, JOSHUA ANDERSON and COURTNEY CURRY, and
alleges:

Plaintiff, RONALD N. LARSON, sues Defendants JOSHUA ANDERSON and COURTNEY CURRY, and
alleges:
10. This is an action for damages which exceed $2,500.00 but which are less than $5,000.00.
11 Plaintiff realleges paragraphs two through five above and incorporate them here by
reference.
12. During the course of the tenancy Defendant has damaged the property belonging to
Plaintiff consisting of damages to the interior of the premises and the exterior of the premises. At the time of the
filing of this action Plaintiff is unaware of the full extent of the damages.
13. As a result of the actions of Defendant damaging the property Plaintiff will incur expenses
to make repairs and have suffered a diminution in value of the property.
WHEREFORE, Piaintiff prays for a judgment for damages and costs.

RESIDENTIAL LEASE
THIS AGREEMENT entered into this/P 44 day of May, 2020, by and between
Ronald N. Larson, hereinafter, “LANDLORD” and Joshua Anderson and Courtney
Curry, hereinafter, “TENANT”.
WHEREAS, LANDLORD hereby leases to TENANT the premises described
below upon the following terms and conditions:
1 DECRIPTION OF PREMISES. The property to be lease is described as
follows:

2. TERM. The lease shall commence at 12:01 A.M. on May 15, 2020 and
shall terminate at 11:59 P.M. on May 31, 2021.
3 RENTAL PAYMENTS. TENANT shall pay LANDLORD as rent for
the above described property during the term described above in equal installments of
$1,300.00 per month in advance on the 1% day of each calendar month to be paid to the
LANDLORD at the following address: 23227 Freedom Avenue, Port Charlotte, FL
33980, or at such other place as the LANDLORD may designate.
4. SECURITY DEPOSIT. Prior to the execution of this agreement,
TENANT shail deposit with LANDLORD the sum of 1,300.00 as a security deposit and
$350.00 water deposit for the full and faithful performance by TENANT of all terms of
this agreement. This sum shall be returned to TENANT at the end of the above described
term without interest provided TENANT has fully and faithfully carried out all terms and
condition to be performed by TENANT. It is agreed, however, that LANDLORD, in the

event of any default or damage to the premises, may apply such security deposit or any
part thereof to cure any default under this agreement or to make repairs necessitated by
TENANT and may also apply the deposit or any part thereof on account of any rent or
other sums due.
§. USE OF PREMISES. The leased premises shall be used solely for
single-family residential purposes by the undersigned TENANT, only. No unlawful or
offensive use shall be made on the premises, and no act or thing shall be done or
permitted thereon which may constitute a nuisance or which may void or make voidable
any insurance upon such premises against fire or otherwise. No persons other than the
undersigned TENANTS shall reside on said premises.
6. ASSIGNMENT AND SUBLETTING. This lease shall not be assigned
nor the leased premises or any portion thereof sublet without the prior written consent of
LANDLORD, and any such assignment or subletting without such prior written consent
shall constitute a breach of this agreement, and shall be null, void, and of no effect
whatsoever.
7. MAINTENANCE. TENANT shall maintain the leased premises in a
clean, neat and orderly condition and shall deliver same to LANDLORD upon
termination of the term of this agreement in as good condition as at the commencement
thereof, accepting only ordinary wear and tear. Repairs required as a result of damage

8. REPAIRS. TENANT shall notify LANDLORD promptly of any damage
to the interior or exterior of the leased premises. Repairs required as a result of damage
caused by TENANT shail be charged to the TENANT as additional rent or deducted from
the security deposit as described above. Any damage to the interior or exterior of the leased
premises caused by the willful or negligent act of TENANT or TENANTS’ invitees shall
be the responsibility of TENANT. Tenant shall pay the first $50.00 of any and all repairs.

abated. If such repairs are made within 10 days the lease shall continue in effect but rent
during the period of un-inhabitability until repairs are completed shall be refunded to

12. ACCESS BY LANDLORD. The LANDLORD, or his agents, shall have
the right to enter, inspect and make needed repairs to the leased premises, and to show the
same for future lease or sale, at any reasonable time.
13. QUIET ENJOYMENT. The LANDLORD covenants that he is the
lawful owner of the above described premises and has full right and authority to lease
said premises. TENANT shal] have quiet enjoyment of the premises and shall not be
evicted or disturbed in possession of the premises as long as TENANT complies with the
terms of the agreement.
14, LEASE RENEWAL. TENANT shall notify LANDLORD at least thirty
(30) days prior to the expiration of the term of the agreement of his/her intentions to
renew the lease of the above described premises beyond the date of the termination of
this agreement, but nothing herein shall be construcd to require LANDLORD to renew
the lease or prevent him from changing any terms, conditions or payments in the event
LANDLORD agrees to a renewal or extension of the lease period.
15, NOTICES. Any notice required or permitted to be given by law or under
this agreement to LANDLORD shall be given at the following address: 23227 Freedom
Avenue, Port Charlotte, FL 33980; and all notices required or permitted to be given by
law or under this agreement to TENANT shall be given at the leased premises. Any said
notice properly mailed by LANDLORD by certified mail, with postage and fees pre-paid,
shall be deemed delivered when mailed, whether or not received.
16. PETS. TENANT shall not allow any animals or pets of any nature or
kind to enter or remain on the leased premises.
17. OTHER PROVISIONS. No smoking in the house at any time. No
parking on the grass. A late fee of $10.00 per day after the 5" day of each month shall be
due as additional rent.
18. REQUIRED STATEMENT. Florida Statutes Chap ter
