LARSON, sues Defendants, JOSHUA ANDERSON and COURTNEY CURRY, and alleges: 1 This is an action to evict tenant from real property located in Charlotte County, Florida. 2. Plaintiff owns certain real property located in Charlotte County, Florida, consisting of a residence located at 18415 Arapahoe Circle, Port Charlotte, Florida. 3 Defendant has possession of the property under a lease agreement to pay rent of $1,300.00 per month beginning on May 15, 2020. A copy of the Lease is attached hereto as Exhibit "A". 4 Defendants have failed to timely vacate said property upon expiration of lease. 5 Plaintiff served Defendants with a Notice to Pay Rent or Deliver Possession, but Defendants refused to vacate. WHEREFORE, Plaintiff pray x judgment for damages and costs. COUNT Ill - DAMAGES Plaintiff, RONALD N. LARSON, sues Defendants JOSHUA ANDERSON and COURTNEY CURRY, and alleges: 10. This is an action for damages which exceed $2,500.00 but which are less than $5,000.00. 11 Plaintiff realleges paragraphs two through five above and incorporate them here by reference. 12. During the course of the tenancy Defendant has damaged the property belonging to Plaintiff consisting of damages to the interior of the premises and the exterior of the premises. At the time of the filing of this action Plaintiff is unaware of the full extent of the damages. 13. As a result of the actions of Defendant damaging the property Plaintiff will incur expenses to make repairs and have suffered a diminution in value of the property. LARSON 23227 Freedom Avenue Port Charlotte, Florida 33980 RESIDENTIAL LEASE THIS AGREEMENT entered into this/P 44 day of May, 2020, by and between Ronald N. Larson, hereinafter, “LANDLORD” and Joshua Anderson and Courtney Curry, hereinafter, “TENANT”. WHEREAS, LANDLORD hereby leases to TENANT the premises described below upon the following terms and conditions: 1 DECRIPTION OF PREMISES. The property to be lease is described as follows: 18415 Arapahoe Circle, Port Charlotte, FL 33948 2. TERM. The lease shall commence at 12:01 A.M. on May 15, 2020 and shall terminate at 11:59 P.M. on May 31, 2021. 3 RENTAL PAYMENTS. TENANT shall pay LANDLORD as rent for the above described property during the term described above in equal installments of $1,300.00 per month in advance on the 1% day of each calendar month to be paid to the LANDLORD at the following address: 23227 Freedom Avenue, Port Charlotte, FL 33980, or at such other place as the LANDLORD may designate. 4. SECURITY DEPOSIT. REPAIRS. TENANT shall notify LANDLORD promptly of any damage to the interior or exterior of the leased premises. Repairs required as a result of damage caused by TENANT shail be charged to the TENANT as additional rent or deducted from the security deposit as described above. Any damage to the interior or exterior of the leased premises caused by the willful or negligent act of TENANT or TENANTS’ invitees shall be the responsibility of TENANT.
