DEFENDANT'S MOTION TO COMPEL DEPOSITIONS
Defendant, TYPTAP INSURANCE COMPANY, by and through its undersigned
counsel, and pursuant to the Florida Rule of Civil Procedure seeks the entry of an Order
compelling Plaintiff to provide deposition dates for the requested depositions, and states
as folk)ws:
1. This case arises out of a first party property claim under a homeowners policy
issued by Defendant.
2. This case is currently set for trial for the period beginning January 9,2023,
through February 3,2023.
3. Defendant has requested dates the depositions Plaintiffs' loss consultant from
Pelican Property Solutions as well as Jose R Uz from Caribbean Inspectors
& Consultants, Inc.,however Plaintiff has failed to provide dates to schedule
same.
4. On July 22,2022, counsel for Defendant requested the deposition of Jose F.
Uz of Caribbean Inspectors & Consultants, Inc. See electronic
correspondence dated July 22, 2022, attached hereto in composite Exhibit
"A-"

9. On December 2, 2022, counsel for Defendant again followed up on its

10. On October 5, 2022, counsel for Defendant requested the deposition of the
Plaintiffs' loss consultant of Pelican Property Solutions. See electronic

11. On December 2, 2022, counsel for Defendant followed up on its request for

12.To date Plaintiffs have failed to provide dates or cooperate in setting the
depositions of the Plaintiffs' loss consultant from Pelican Property Solutions
or Jose F. Uz of Caribbean Inspectors & Consultants, Inc.
13.As a result,Defendant has been obligated to seek court intervention.
14. Defendant requires these depositions in order to prepare its defense of this
matter. Defendant requests that the Plaintiffs be compelled to provide dates
for the requested depositions of Plaintiffs' loss consultant from Pelican
Property solutions and Jose F. Uz of Caribbean Inspectors & Consultants,
Inc., within five (5) days of the date of this Court's Order as Defendant has
been and continues to be prejudiced by Plaintiffs' failure to respond to these
requests.
WHEREFORE, Defendant, TYPTAP INSURANCE COMPANY, respectfully
requests that this Honorable Court grant Defendant's Motion and enter and Order
requiring Plaintiffs to provide deposition dates for the requested depositions within five
days of this Court's Order and for any other relief this Court deems proper.
