A lawsuit has been filed against you. You may, but are not required, to file a written response to
this Summons and the attached Statement of Claim with the Clerk of the Court. A phone call will not
protect you. If you decide to file a written response it should include: the case number given above, the
names of the parties, and your contact information including address, phone number and email address.
Your case will be scheduled for mediation. All hearings and mediation will be conducted by
ZOOM or telephonically. Even if you file a written response, you are still required to participate in
mediation.
A corporation may be represented at any stage of these court proceedings by an officer of the
corporation or any employee authorized in writing by an officer of the corporation. Written
authorization to do so must be filed with the Court prior to any proceeding. All attorneys
appearing must have settlement authority from their clients prior to the proceeding.
FOURTH JUDICIAL CIRCUIT
COUNTY COURT MEDIATION PROGRAM
You will be contacted to participate in a small claims mediation. During this session, you will
have the opportunity to take advantage of the County Court Mediation Program. This program provides
both parties with an opportunity to resolve their dispute without returning to court for trial. The
Mediation Program has a 72% resolution rate.
The Program uses volunteer mediators trained and certified by the Florida Supreme Court.
These mediators help parties to try to reach a mutually acceptable agreement. The mediator cannot
provide legal advice or tell you if you have a good case. However, the mediator is there as a neutral party
seeking to help the parties reach a resolution. If you are unable to reach an agreement, your case will be
set for pre trial at a later date.
There is no cost for this service.
Mediation is an alternative to trial and allows both parties to participate in the resolution of their
dispute. Mediation provides certainty and finality to the case. In a trial, the judge makes a final decision.
In mediation, the parties compromise to come to a mutually agreed upon resolution to the dispute.
Mediation can and does work.

Right to Venue. The law gives the person or company who has sued you the right to file suit in any
one of the several places as listed below. However, if you have been sued in any place other than
one of these places, you, as the Defendant, have the right to request that the case be moved to a
proper location or venue. A proper location or venue may be one of the following: (1) Where the

contract was entered into; (2) If suit is on unsecured promissory note, where note is signed or
where maker resides. (3) If suit is to recover property or to foreclose a lien, where the property is
located; (4) Where the event giving rise to the suit occurred; (5) Where any one or more of the
defendants sued reside; (6) Any location agreed to in a contract; (7) in an action for money, due if
there is no agreement as to where suit may be filed, where payment is to be made.
If you as a Defendant, believe the plaintiff has not sued in one of these correct places, you must appear
on your court date and orally request a transfer, or you must file a WRITTEN request for transfer in
affidavit form (sworn to, under oath) with the court seven days prior to your first court date and send a
copy to the plaintiff(s) or plaintiff(s’) attorney, if any.
