Plaintiff having moved for an order pursuant to CPLR3215(i), seeking an order directing
the Clerk of the Court to enter judgment against defendant, DONNA MARIE RUGINO, due to
his/her default in the terms of payment of a stipulation of settlement, and said motion
having regularly come on to be heard before me on the day of 2023.
NOW, upon reading the Notice of Motion dated , the affirmation of AMY
GAVLIK, affirmed to be true pursuant to CPLR2106 Dated , and all other
papers and proceedings previously had herein and annexed as xhibits thereto, from all of
which it appears defendant, DONNA MARIE RUGINO, herein defaulted in payments pursuant to
a stipulation of settlement; and this matter having been duly presented to this Court,
with proof of service upon the defendant annexed to the moving papers, and due
deliberation having been had hereon.
NOW, on motion of MULLOOLY,JEFFREY,ROONEY & FLYNN, LLP, attorneys of record for the
plaintiff, Bank of America, N.A., it is
ORDERED, that the plaintiff have judgment against defendant(s), DONNA MARIE RUGINO, for
the amount of $13,452.66, plus costs and disbursements, less credits for payments made as
computed in the annexed affirmation of AMY GAVLIK, in the amount of $4,427.50; and that
is further
ORDERED, that the Clerk of this Court, upon service upon him of a conformed copy of this
Order and the presentation of appropriate judgment papers to the Clerk by the attorneys
for the plaintiff, is directed to enter judgment in favor of plaintiff and against
defendant accordingly.
