NOW COMES Herlinda Sieger as Representative of the Estate of Daniel Sieger, Cross-
Claimant and files this Cross-Action against PeopleReady, Inc. and DBNK Contracting LLC
d/b/a Blue Team Restoration, LLC and for cause says:
I.
PeopleReady, Inc. is a defendant in this matter and may be served through its attorney of
record, Marcy Lynn Rothman, Kane Russell Coleman Logan, P.C., 5151 San Felipe St., Suite
800, Houston, Texas 77056.
DBNK Contracting LLC d/b/a Blue Team Restoration, LLC (hereinafter “Blue Team
Restoration”) is a third-party defendant in this matter and may be served through its attorney of
record, Mike Mills of Atlas, Hall & Rodriguez, 818 Pecan Blvd., McAllen, Texas 78501.

The Estate of Daniel Sieger denies any liability to any party in this lawsuit. However,
Defendant the Estate of Daniel Sieger would show that if the Plaintiffs, Alicia Perales, as
Representative of the Estate of Mario A. Perales and as Next of Friend of S.M. Perales and M.
Perales, Jr., Minor Children are entitled to any judgment against the Estate of Daniel Sieger,
which is denied, then, in that event, the Estate of Daniel Sieger, is entitled to indemnity, credit
and/or contribution from PeopleReady, Inc. and Blue Team Restoration because at the time of
the accident, Daniel Sieger was in the course and scope of his employment and benefit for
PeopleReady, Inc. and Blue Team Restoration. Specifically, when Daniel Sieger was tasked
with picking up a generator from Brownsville to be delivered to Victoria, in addition to the duty
to drive Mario Perales to and from the job sites.
III.
The Estate of Daniel Sieger would further show that in the event it is held responsible to
Plaintiffs, Alicia Perales, as representative of the Estate of Mario A. Perales and as Next of
Friend of S.M. Perales and M. Perales, Jr., Minor Children or to any other party herein, then the
Estate of Daniel Sieger is entitled to judgment against PeopleReady, Inc. and Blue Team
Restoration, for Contribution, Credit, and/or indemnity pursuant to Chapters 32 and 33 of the
Texas Civil Practice and Remedies Code, or any other law of the State of Texas under which it is
entitled to contribution or indemnity, together with its costs and reasonable attorney’s fees in
connection herewith.
PRAYER
WHEREFORE, PREMISES CONSIDERED, Cross-Claimant, the Estate of Daniel
Sieger, prays that Plaintiffs, Alicia Perales, as representative of the Estate of Mario A. Perales
and as Next of Friend of S.M. Perales and M. Perales, Jr., Minor Children, take nothing by their
