On this day, the Court considered Third-Party Defendant/Fourth-Party Plaintiff, Big Tex
Air Conditioning, Inc.’s, (“Big Tex”), Motion to Compel Arbitration as to the Fourth-Party
Defendants. After considering the Motion, any Response and arguments of counsel, if any, this
Court is of the opinion that Third-Party Defendants’ Motion to Compel should be granted.
IT IS ORDERED that, any party with a claim against another party shall have those parties
joined, and the arbitrator shall initially resolve any and all arbitrability disputes raised by any party;
and, subject to the arbitrator’s resolution of such arbitrability disputes in favor of arbitration,
proceed with arbitration of all claims at issue in the present matter.
IT IS ORDERED, the arbitration shall include Plaintiffs, the Taylor Morrison Defendants,
and the following Fourth-Party Defendants:
• Arnulfo Rodriguez Roofing Co., Inc. (“Rodriguez”)
• City Framers, LLC (“City Framers”)
• Troy A. Clay, d/b/a Clay Custom Builders (“Clay”)
• Chaparral Plumbing, LP (“Chaparral”)
• Builder Services Group, Inc., d/b/a Williams Contractor Services (“BSG”)
IT IS FURTHER ORDERED that all claims amongst the parties, including those claims
against the Fourth-Party Defendants, are stayed.
It is therefore
ORDERED, ADJUDGED, and DECREED that Fourth-Party Plaintiff Big Tex’s Motion
to Compel Arbitration as to Fourth-Party Defendants and Plea in Abatement is hereby GRANTED
in its entirety.
