TO THE HONORABLE COURT:
Defendant COG Operating, LLC (“COG”) files this Answer to Plaintiff’s Fifth Amended
Petition. In support thereof, COG respectfully shows this Court as follows:
1. Pursuant to Texas Rule of Civil Procedure 92, COG generally denies each and
every material allegation and contention set forth in Plaintiff’s Fifth Amended Petition and any
amendment thereto, and hereby demands strict proof of the same.
2. Plaintiff’ s Fifth Amended Petition does not comply with the requirements of
Texas Rule of Civil Procedure 783 and, therefore, does not properly assert a claim for trespass to
try title. As an example, Plaintiff does not provide the requisite property description or specific
description of the interest claimed by Plaintiff. At least in part due to Plaintiff’ s pleading
deficiencies, COG specifically denies that COG has possessed (or currently possesses) the
premises sued for by Plaintiff. Further, COG pleads “not guilty.”
3. COG specifically denies that all conditions precedent to Plaintiff’ s claims against
COG OPERATING, LLC’S ORIGINAL ANSWER PAGE 1
COG have been performed or have occurred.
4. COG asserts that Plaintiff’s claims are barred by the statute of limitations.
PRAYER
WHEREFORE, COG prays that Plaintiff take nothing by its suit against COG and that its
claims against COG be dismissed with prejudice. COG also pleads for such other and further
relief, at law or in equity, to which it may show itself justly entitled.
