       On this day, came on to be heard, Defendant Eagle Oil       8t   Gas Co.’s ("Eagle” or

”Defendant”) Motion for Traditional Summary Judgment on Statute of Limitations and

Laches (the ”Motion”). Having considered the pleadings on file, the Objections, the

response, the reply, if any, the admissible evidence on file, and the arguments of counsel,

the Court is of the opinion that Defendant Eagle’s Motion should be      DENIED.
