Dear Judge Slaughter:
Today we have uploaded an Order on Defendants’ Renewed Motion to Compel that the
Court heard Via Zoom last Thursday. In the interim, we have conferred with Plaintiffs’ counsel
with respect to the form of that Order and are disappointed to report that there is disagreement with
regard to the rulings of the Court.
More specifically, Plaintiffs now contend that the Court granted (or should grant) relief
with respect to all other parties’ production. We do not recall that the Court granted any relief to
the Plaintiffs with respect to “all other parties’ productions,” particularly in the absence of any
motion or hearing regarding such request, or any such request ever yet being asserted by the
Plaintiffs in their discovery responses. We do recall that the Court specifically declined to rule on
matters not before the Court.
The Defendants, including Cheyenne Asset Management, believe that this Order accurately
reflects the Court’s rulings last week.
