Subsequent to the filing of the Motions to Compel, counsel for Plaintiffs
contacted Defendants’ counsel with respect to Defendants’ certificate of
conference letter sent before they filed the Motions to Compel. Based on the
representations and agreements of Plaintiffs’ counsel in that conferral letter
response:
1. In the Trustees’ Motion to Compel the following are no longer at issue:
a) answers to Interrogatories No. 3, 9 and 10; and b) answers to Request
for Admissions 7-9, 16-17, 21, 37-39 and 46-47.
