        I, Krista A. Lionello, being duly sworn, depose and say:

        1 lam over the age of eighteen (18) years and believe in the obligations of an oath.      I am
employed as a paralegal by Brock & Scott, PLLC, Plaintiff's attorneys in this action.

         2. Upon information and belief, the defendant Robert W. Miller, Jr. (the “Defendant”) is not in
military service, as that term is used in the federal Servicemembers Civil Relief Act.

        3. The basis for my belief is a report from the Defense Manpower Data Center (“DMDC”) of the
