                             PLAINTIFF’S MOTION TO COMPEL                              DEPOSITION DATES

               Comes now the Plaintiff, RUTH                    RAPHAEL         (“Plaintiff”), by and through undersigned

        counsel, files its Motion to Compel Deposition Dates:

                1           Plaintiff has requested deposition dates for Defendant’s corporate representative

        and Defendant’s field adjuster Patrick Chichester.

               2.           Mr. Chichester inspected the property on Defendant’s                        behalf in relation to the

        Hurricane     Ian    property         damage   loss    at issue     in this    lawsuit,   and    also     drafted      the   letter

        communicating Defendant’s position that the loss was not covered under the subject policy.

               3            Defendant has not produced any deposition dates.

               4            Plaintiff respectfully       requests that this Honorable             Court compel         Defendant to

        produce deposition dates for the above witnesses.

               WHEREFORE,                Plaintiff requests         that this Court     grant Plaintiff's       motion,        and grant

        Plaimntiff any additional relief that the Court deems just and proper.
