TO THE HONORABLE JUDGE OF SAID COURT:

       COMES      NOW     Charles A. Abernathy, Jr. Plaintiff, in the above-captioned cause, and

respectfully request that a subpoena duces tecum be issued to require the custodian named below

or someone acting on his or her behalf to produce the items described below:

            Huntsville, TX 77320

            Produce documents or tangible things, specifically copies of commissary deposits for

            the Defendant (inmate #2229819) from January 1, 2019 to Present.

            Documents to be made available and mailed to ETC & CO, 8220 Louetta Rd., Suite

            152A #15, Spring, TX      77379, to permit such party to inspect such documents and

            tangible things in their possession, custody or control.

       4.   Please contact Charles Abernathy, Jr. upon completion of subpoena at (432) 212-1118.


       WHEREFORE, Plaintiff prays the Court grant this A pplication for Subpoena Duces Tecum

as evidence is relevant pursuant to Texas Rule of Evidence 401.
