1 This action was commenced to foreclose a mortgage against the property known as 2536
EAST 64TH STREET, BROOKLYN, NY 11234 and bearing tax map designation: Block: 8641
Lot(s): 43. The summons, complaint and notice of pendency were filed on or about December 30,
2016,
2 Upon information and belief, all of the defendants have been served with the summons
and complaint in this action and none of the defendants have answered or appeared in this action and
their time to do so has expired and has not been extended.

3 Upon information and belief, none of the defendants herein is an infant, incompetent
person for whom a committee has been appointed, conservatee, absentee and no person not a party has
an interest in the subject matter of this action.
4 After the commencement of this action, Plaintiff requested that the action be
discontinued and the notice of pendency canceled due to the loan being paid off. Accordingly, the
above entitled action, together with all counterclaims be and the same is hereby discontinued; and the
Notice of Pendency filed in the within action is hereby canceled without costs to any of the parties.
5 No Receiver or Referee has been appointed in this action.
6 A Judgment of Foreclosure and Sale has not been granted in this action.
7 No prior application has been made for the relief requested herein.
WHEREFORE, your affiant respectfully prays that this affidavit be entered herein canceling the
notice of pendency heretofore filed in this action.
