MELVIN A. MIZHQUIRI being duly sworn, deposes and says:
1. I am the Plaintiff.
2. On September 29, 2017 I was the operator of a 2016 Nissan that was involved in a
motor vehicle accident.
3. My vehicle was hit hard in the rear. When my vehicle was hit, my body moved
backwards and forward. My body slammed backwards against the seat and headrest and then
jerked forward and back again. I hit my right knee on the dashboard area of the vehicle. I braced
myself with my hands against the steering wheel to avoid hitting my head against it.
4. After the accident, I felt pain in my neck, back, right shoulder, right wrist, right
knee and right ankle.
5. The pain continued and my brother referred me to Brooklyn Medical. I went there
the Monday after the Friday evening accident after the pain continued through the weekend.
6. My treatment at Brooklyn Medical was supervised by Dr. Salehin. I did physical
therapy, acupuncture, and chiropractic. I treated here from October 2017 to early 2020,just before
the pandemic started.

7. Dr. Salehin also sent me for MRIs of my right shoulder, neck, and back. The MRls
showed a tear in my right shoulder and injuries to the discs in my neck and back.
8. Dr. Salehin also sent me for nerve studies that showed the injuries to my discs were
affecting my nerves.
9. I continued treating with small improvements.
10. When the pain did not go away, Dr. Salehin referred me to Dr. Apple, who gave
me injections in my neck and lower back.
11. I was scared to have surgery so I continued conservative treatment.
12. The treatment helped but the pain did not go away. It would get better and then get
worse again. Because of the pain, I could not lift things like groceries or my kids anymore, carry
things, sit for long periods, stand for long periods, or exercise at the gym.
13. My injuries continue to cause me pain and limit my physical ability today.
14. I never hurt any of these body parts before or añer this accident.
