Plaintiff, for its Complaint or Forfeiture, states and alleges as follows:
1. That Defendant property is a motor vehicle as defined in Minn. Stat. §609.487,
Subd. 2(a);
2. That the motor vehicle owner is listed as Matthew Seth Desiderio
(DOB/08/25/1989) of 31729 State Hwy 6, Emily, MN, 56447.
3. That the actual owner of the vehicle is Matthew Seth Desiderio
(DOB/08/25/1989) of 31729 State Hwy 6, Emily, MN 56447.
4. That Defendant property was operated by Matthew Seth Desiderio on State
Highway 6 in the City of Crosby, County of Crow Wing, State of Minnesota, on or about August
21, 2023, at or after 3:42pm in the commission of an offense designated in Minn. Stat.
§609.5312, to wit; fleeing a peace officer in a motor vehicle and endangering life or property.
5. That Defendant property was operated by Matthew Seth Desiderio on State
Highway 6 in the City of Crosby, County of Crow Wing, State of Minnesota, on or about August
21, 2023, at or after 3:42pm. Matthew Seth Desiderio's conduct in refusing to test will result in a
designated license revocation in conjunction with operating Defendant pursuant to Minn. Stat.
§169.63 Subd. 1(e) and Subd. 9.
6. That the appropriate agency herein is the Crosby Police Department.

WHEREFORE, Plaintiff prays tliat the Court:
1. Order the Forfeiture of Defendant property to the appropriate agency for
disposition in accordance with Minn. Stat. Section §609.5315.
2. Order the Forfeiture of Defendant property to the appropriate agency for
disposition in accordance with Minn. Stat. Section §169.63 Subd. 1(e) and
Subd. 9.
3. Grant such other relief as the Court deems appropriate.
