PLEASE TAKE NOTICE that on September 27. 2023 at 9:00 AM. or as soon thereafter as the
matter may be heard in Department S26 of the above-emitled Court, located at 247 West Third Street, San
Bemardino, California 92415. Defendant TA OPERATING LLC ("TA”) will and hereby move the Court
for an order compelling Plaintiffs PHILIP DANIELS, MARKUS BEGAY, LIVA SIAOSL PERRY
VASQUEZ, WILLIE CALVIN BRYANT and [MRAN AYUB ("Plaintiffs”) to arbitrate any gateway
challenges regarding the interpretation 0r enforceability of the parties” arbitration agreements in
accordance with the delegation provision in the agreements. Altematively. should the Court reach the
substantive issues. TA will and hereby does move the Court for an order pursuant to the Federal
11 Arbitration Act. 9 U.S.C. § l. eI seq. ("FAA"): (i) compelling arbitration 0f Plaintiffs” individual Private
12 Attorneys General Act of 2004. California Labor Code §§ 2698. e1 seq. ("PAGA") claims on an
13 individualized basis; and (ii) staying this action in favor 0f the earlier filed PAGA actions against TA 0n
14 the grounds of exclusive concurrent jurisdiction or, in the alternative, staying this action pending
15 completion ofthe arbitration ofPIaintiffs‘ individual PAGA claims.
16 TA brings this Motion 0n the grounds that Plaintiffs voluntarily entered into enforceable written
17 arbitration agreements, which clearly and unmistakably delegate authority to the arbitrator t0 decide all
18 challenges to the interpretation or enforceability 0f the agreements. As such, this Court should follow the
19 well-reasoned precedent of every other coun that has been asked to review TA’s agreement and not entertain
20 any substantive challenges to the arbitration agreements. (TA‘s Request for Judicial Notice ("RFJN”),
21 Exhibit l [Order Granting Motion to Compel Arbitration. Daniels. et a]. v. TA OPERA THVG, LLC, et al., San
22 Bemardino Superior Coun Case No. CIV882215247]; Holley-Gallegly v. TA Operating. LLC (9th Cir. July
23 21. 2023) No. 22-55950, 2023 U.S. App. LEXIS 18579; Taylor v. TA Operating, LLC (E.D. Cal. Jan. l2,
24 2023) N0. 2:22-Cv-00947 WBS DMC, 2023 U.S. Dist. LEXIS 6318; Chandler v. TA Operating LLC (ED.
25 Cal. Feb. 24. 2022) No. 2:20-cv-0209l-TLN-DMC, 2022 U.S. Dist. LEXIS 3519].) Nevertheless, even if
26 exclusive jurisdiction to decide any gateway issues regarding the agreements did not rest solely with the
27 arbitrator. the parties” agreements to arbitrate are valid and enforceable under the FAA and require Plaintiffs
28 to bring all disputes. claims or controversies arising out of or relating to their employment with TA "on an
