JARRATIVE
On September 30, 2021, at approximately 1:31 a.m., | was in the 3800 block of 12th Street when | observed a bicycle
traveling north on 37th Avenue. The bicycle operator turned east onto 12th Street without stopping at the stop sign.
After turning onto 12th Street, the bicycle operator traveled east in the middle of the westbound lanes for a short
distance before returning to the eastbound lane.
| initiated a traffic stop in approximately the 3500 block of 12th Street. The bicycle operator identified himself as
Michael Anthony Torres via Florida Departmentof Corrections ID Card. | asked Mr. Torres for his permission to pat
him down for weapons and he consented. | then asked Mr. Torres for his permission to search his clothing and he
consented to this as well.
Upon searching Mr, Torres clothing, | removed a small, transparent plastic container from his right front pants
pocket. Upon further inspection, | could see numerous plastic jeweler's bags which contained a small amount of
residue from a crystalline substance. Based on my training and experience, this substance appeared to be
methamphetamine. | placed Mr. Torres into handcuffs without incident and continued my search.
| lifted Mr. Torres’ shirt and observed a black zipper pouch container concealed within his waistband. Upon
unzipping the container, | observed a digital scale with methamphetamine residue on it. | also located a medium-
sized plastic jeweler's bag which contained numerous smaller plastic bags. These smaller plastic bags all
contained approximately the same amount of methamphetamine Inside of each bag. The total weight of all of the
plastic bags containing methamphetamine was approximately 3 grams. inside of the zippered container there was
also a small white plastic container. Upon opening the white container, I located several small plastic jeweler's bags
containing small amounts of a grey powder substance. Each of these bags weighed approximately 0.10 grams
which are commonly referred to as "points". Mr. Torres also had two working cell phones.
1 conducted a post-Miranda interview with Mr. Torres. Mr. Torres admitted to having knowledge of and possessing
methamphetamine and heroin. | showed Mr. Torres a plastic bag containing suspected methamphetamine and
asked him what it was; Mr. Torres stated that the substance was methamphetamine. | then asked Mr. Torres where
the heroin was and he stated that it was in the white container. Upon opening the container and displaying the gray
powder substance to Mr. Torres he stated that was the heroin he was referring to.
The suspected methamphetamine was field tested and returned a positive indication for the presence of
methamphetamine. The suspected heroin was field tested and returned a positive indication for the presence of
fentanyl
When | inquired about the packaging of the substances, Mr. Torres admitted to actively selling both
methamphetamine and heroin. Mr. Torres stated that priorto me pulling him over he had just left a house where he
gave a female subject methamphetamine. Mr. Torres further stated that he sells the methamphetamine for $60 per
gram or $120 per 3.5 grams (commonly referred to as an 8-ball), When | asked Mr. Torres how much he sold a point
of heroin for (1/10 of 1 gram) he stated $30.
Based on the packaging of the methamphetamine and heroin, the fact that the bags were al! approximately the
same size and weight, the digital scale in Mr. Torres' possession, and Mr. Torres’ own admission to selling
methamphetamine and heroin for monetary gain, there is probable cause to believe that Mr. Torres did possess
with intent to sell methamphetamine and heroin.

Subsequent investigation revealed that Mr. Torres was released from the Florida Department of Corrections in July
of 2021. Mr. Torres served a 14-month sentence for Sale/Manufacture/Deliver Methamphetamine, Possession of
Methamphetamine, and Possession of Heroin.
Mr. Torres was transported to the Indian River County Jail without incident.
