As to those facts based on information and belief, I believe them to be true. 2. Iam an attorney with the firm BARON & BUDD, P.C,, attorneys of record for plaintiffs. 3. may be substantially prejudiced ifSCOTT MORRISON, ‘believe that Plaintiffs 10 an out-of-state attorney, does not receive pro hac vice admission in time to conduct the il deposition testimony ofMr. CHARLES BOUDREAUX. Any undue delay may result in an 12 inabitity to preserve his testimony or force Plaintiffs to incur the expense of hiring a contract 13 attorney. 4 4. Due to the complex nature of asbestos cases, trial requires multiple attorneys 15 to properly prepare for trial, respond to pretrial motions, argue pretrial and trial motions and 16 objections, voir dire the jury, examine witnesses, offer documents into evidence and ensure 17 the trial procecds smoothly. BARON & BUDD, P.C., the law firm retained by Plaintiffs to 18 represent them in the instant action, is a Jaw firm based in Dallas, Texas. Currently, ERIC 19 BROWN is the one California licensed attorney at Baron & Budd, P.C. qualified to try the 20 asbestos case, but it is physically impractical for her to try the case alone. SCOTT 21 MORRISON is an attorney at BARON & BUDD, P.C. who has tried many asbestos cases and 22 his participation in the proceedings will ensure the trial is handled efficiently and expeditiously 23 due to his knowledge and experience with the issues and areas of dispute at trial. In light of the urgent need Plaintiffs have for SCOTT MORRISON's services, PlaintiffS respectfully ask the Court to grant this ex parte application for an order shortening time. 7. A copy of this ex parte pro hac vice application for SCOTT MORRISON, has been served by mail to the State Bar of California, and payment of $50.00 by check for the ‘equired application fee pursuant to C.R.C, 983 was mailed with the application, A true and correct copy of the letter and check mailed on April 27, 2007 is attached hereto as Exhibit «AP, 13 8 Attached hereto as Exhibit “B” is a true and correct copy of the Declaration of SCOTT MORRISON in support of the pro hac vice application herein 9.
