INJUCTIVE RELIEF
The above-captioned matter came before the Honorable Carol M. Hanks on April 5, 2023,
at the Waseca County Courthouse, Waseca, Minnesota, on Petitioner Michael Roehrs’ Motion for
Preliminary Injunction. Appearances were noted on the record.
Following the hearing, counsel for the parties requested an opportunity to submit written
legal briefs on the issues relating to the preliminary injunction by April 20, 2023. The Court then
took the matter under advisement.
Based upon all the files, records and proceedings herein, the Court makes the following:
ORDER
1. Petitioner Michael Roehrs’ Motions for Preliminary Injunction to remove Marvel
Roehrs as trustee of the above Trust and prohibit Trustee from renting the trust farmland under the
terms of the Lease she executed for the 2023-2024 crop season are DENIED.
2. The Scheduling Conference set for August 2, 2023, at 9:15 a.m. via Zoom shall
remain on the Court’s calendar. Parties shall file their Scheduling Statement or Discovery Plan
with the Court prior to August 2, 2023.
