DALLAS COUNTY, TEXAS ORDER GRANTING DEFEN ANTS’ AGREED AMENDED MOTION TO SEVER AN FOR ENTRY OF FINAL JUDGMENT FOR DEFEN ANTS JAMES AMOS, STEPHEN BATMAN, REAGAN STEWART, AND MICHAEL L. WHALEN Having considered Defendants James Amos, Stephen Batman, Reagan Stewart, Michael L. Whalen’s Agreed Amended Motion to Sever and for Entry of Final Judgment (the “Motion”), any responses thereto, all applicable pleadings, the evidence submitted, if any, the arguments of counsel, if any, and the applicable law, the Court finds that the Motion should be, and is in all things, GRANTED. It is, therefore, ORDERED that Defendants’ Agreed Amended Motion to Sever and for Entry of Final Judgment for Defendants James Amos, Stephen Batman, Reagan Stewart, and Michael L. Whalen is hereby GRANTED. It is further ORDERED that all claims that were asserted or could have been asserted in this cause of action by Plaintiff against Defendants James Amos, Stephen Batman, Reagan Stewart, and Michael L. Whalen are hereby severed from this cause of action and into a new and separate cause ORDER PAGE 1 of action and cause number to be entered or established by the Clerk. Defendants shall pay the filing fee for the new cause number created by the severance. It is further ORDERED that the Clerk is ordered to copy all filings appearing in Cause No. DC-21- 11479, pending in the 162m Judicial District Court of Dallas County, and include them in the new and separate cause of action and cause number to be entered or established by the Clerk. It is further ORDERED that an Agreed Final Judgment (to be filed by counsel once the new cause number is assigned) shall hereby be entered in the new cause number in favor of Defendants James Amos, Stephen Batman, Reagan Stewart, and Michael L. Whalen, rendering a take-nothing judgement in their favor and an award of attorneys’ fees in their favor in accordance with the Order Granting Defendants Amos, Batman, Stewart, and Whalen’s Motions to Dismiss, signed on April 6, 2022 in this cause of action.
