September 19, 2021 HON. BEVERLY MCGREW WALKER DISTRICT CLERK JUDICIAL DISTRICT COURT FORT BEND COUNTY TEXAS 301 JACKSON ST. ROOM 101 RICHMOND, TX 77469 REF: COURT FILE: 21-DCV-287020 Dear honorable clerk Beverly McGrew Walker, Greeting. In response to court filing dated September 03, 2021 (letter from the court was received on September 13, 2021 by in person hand delivery) to collect my credit card debts by American Express company, please kindly note that, I have been a faithful and excellent member/cardholder of American Express since 1981 (40 years) and has never been delinquent or skipped any payment until the middle of 2020 because of the obvious reason, the great Pandemic (Covid-19) of the 21‘ century which affected everyone globally including myself, where I was forced to be into this very dire financial situation, but American Express has never recognized this and has consistently ignored as well as intentionally overlooked this very real fact and unfortunate natural global health disaster crisis willfully and trying to force me in to something which I am not able to comply due to my unintentional financial inability Lam also behind on all other credit cards payment due to same unfortunate reason, and I have enrolled with a debt management company for a debt consolidate process which I have been making reasonable one monthly payment based on my current limited earnings (less than $1,500 a month when I am offered any courses to teach) for all my credit cards that I have been behind on my payments due to exact same reason I was receiving a small amount of unemployment compensation payments during the first few months of Covid-19 period and | was making my credit cards payment from the 21-DCV- 287020 ANSW 4 Answer/Contest/Response/Waiver AMERICAN EXPRESS COURT FILING RESPONSE Page | 1 6439586 | | | i | ll il unemployment check which also stopped towards the end of 2020, not only it has stopped, but I was also told by the state to pay-back which I have filed an appeal (funds have already been exhausted for payments personal and business related expenses including paying credit card payments) with the Texas Workforce Commission (TWC) and waiting for the results My parttime teaching job (my only real and regular source of income) as an adjunct faculty (contract employment) has been cut-off (taken my name off their rosters) due to low minimum required enrollment for same reason (Covid-19 Pandemic) and me did not get any classes to teach in three consecutive semesters (Spring 2020, Summer 2020, Fall 2020, Spring 2021, Summer 2021, as well as Fall 2021). I have enclosed of email communication to my department chairman for your review. I have received few classes from my second university employment but not in a consistent manner. My parttime side business (training and education and postal business, and parttime independent travel agent) where I was conducting to teach defensive driving and drug & alcohol training classes which also affected significantly due to the global Covid-19 Pandemic and state mandated restrictions and so is my secondary postal and mailing business. I have enclosed my Schedule-C of my 2020 tax return for your review as well I have communicated my dire financial situation with American Express verbally over the telephone as well as in writing. I have offered them to make minimum monthly payment of $25 which is within my current financial limitation. I also advised them; I will increase my payment if my financial situation changes. Additionally, | have requested American Express to waive all fees, penalties, and very high interests (over 30%, same as predatory lenders such as pay-day loans, Pawnshop Loans or Title loans outrageous interest rate) so that, my total balance can be brought down to a much lower amount for a reasonable payment amount. AMERICAN EXPRESS COURT FILING RESPONSE Page | 2 American Express is trying to punish me and others who are behind their payments instead of trying to help during this period of Pandemic which is beyond my control (or beyond anyone’s control). Furthermore, I have also advised them to contact my debt management company to have them consolidate this debt that | owe to American Express, but they have consistently and intentionally refused all options At this time, | would appeal to you and your court to kindly consider these uncontrollable and justifiable facts and dismiss this unreasonable and unjustified lawsuit based on my current dire and unfavorable financial situation. Thank you so much in advance for your kind, fair, human, and consistent judgment based on a very clear reason which has forced millions of Americans to fall into the same financial situation. Sincerely, ANWAR CHOWDHURY 3840 S Dairy Ashford Rd Houston, TX 77082 Ce: JASMINE NECOLE COOKS ZWIKER & ASSOCIATES PC 140 SW FREEWAY. STE 408 SUGAR LAND.
