Please allow this letter to serve as the memorialization of our agreement, pursuant to Rule 11 of
the Texas Rules of Civil Procedure, that:
1. Defendants Hawthorn Suites Franchising, Inc. and Wyndham Hotels & Resorts, Inc. (the
“Wyndham Defendants”) will, later this week, make an initial production of certain non-
confidential documents, including the relevant franchise agreement;
2. Upon entry of a protective order, the Wyndham Defendants will make an additional
production of certain confidential and/or highly confidential materials, including the
applicable system standards manual; and
3. The Wyndham Defendants’ deadline to object, answer, or otherwise respond to Plaintiffs’
first sets of interrogatories and requests for production is reset for February 14, 2022.
