       Defendant Sun Holdings, Inc. (“Defendant”) files this Notice of Appeal and would show:

        1.        Defendant desires to and hereby gives notice of its appeal of the trial court’s

Order Confirming Arbitration Award and Final Judgment entered on April 28, 2023, by The

Honorable Maria Aceves, Presiding Judge of the 192ml Judicial District Court of Dallas County,

Texas, in the above-captioned matter, Cause Number DC-23-01162, styled Hudson Energy

Services,    LLC v.   Sun Holdings, Inc.

       2.         Defendant appeals to the Fifth District Court of Appeals in Dallas, Texas.

       3.         This Notice is timely under Texas Rule of Appellate Procedure 26.1 because it is

filed within ninety (90) days of the date the Judgment was entered on April 28, 2023, after

Defendant filed a Motion to Modifi/ the Final Judgment Confirming Arbitration Award within

thirty days of the Judgment.
