DALLAS COUNTY, TEXAS CITY OF WILMER, TEXAS; and MAYOR SHEILA PETTA, in her official capacity, Defendants. 192ND JUDICIAL DISTRICT ORDER On December 1, 2022, the Court heard Plaintiff EDD RD RV Park LLC's ("Plaintiff' or "EDD") Application for Temporary Restraining Order and Preliminary Injunction (the "Application") against Defendants City of Wilmer, Texas (“City”) and Mayor Sheila Petta, in her official capacity (collectively, "Defendants"). After considering EDD’s Application, the response on file, the pleadings, evidence presented at the hearing, legal authority and the arguments of counsel, the Court is of the opinion that Plaintiff’s Application for Temporary Restraining Order and Injunction should be Denied. However, the Court makes the following findings and orders: (1) Counsel for Defendants must provide at least seventy-two (72) hours’ notice to counsel for EDD before the City takes any action to amend its city limits maps to include EDD’s property within the corporate limits and will include proposed maps with said notice. IT IS THEREFORE ORDERED, ADJUDGED, AND DECREED that Plaintiff has not established a prima facie case to be entitled to a temporary restraining order against the Defendants at this time, however, the Court makes the findings and orders as set forth above.
