plus a $100.00 citation fee, as ordered by the Fort Bend County Commissioners Court.
You are suspected of operating, or causing or allowing the operation of a Motor Vehicle with the
above listed license plate on the Fort Bend County Toll Project on at least two (2) separate
occasions, in violation of the “AMENDED AND RESTATED ORDER ESTABLISHING A
TOLL RATE SCHEDULE FOR THE FORT BEND GRAND PARKWAY TOLL ROAD;
PROHIBITING THE OPERATION OF A MOTOR VEHICLE ON THE ROAD AFTER
FAILURE TO PAY REQUIRED TOLL OR CHARGE; ESTABLISHING AN
ADMINISTRATIVE ADJUDICATION HEARING PROCEDURE FOR VIOLATION OF
THIS ORDER CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT”,
as adopted by the Fort Bend County Commissioners Court on October 24, 2017, and effective on
October 24, 2017 (“Order”) and as amended. All of the violations for which you are charged
within this citation were committed within Fort Bend County, Texas.
Administrative adjudication of the violations is set for the above given scheduled hearing
date, time, and place. You have the right to be present at the hearing to be heard and
present evidence with or without the assistance of counsel. A failure to appear at the hearing
is considered an admission of liability for the failure to pay the amount of tolls and charges
owed. With a finding of liability, the Hearing Officer may issue an order assessing the amount
of the tolls, charges, fees, fines, and court costs.
You may avoid attendance at the hearing by tendering full payment in the amount of
$384.86, by mail using the enclosed coupon and envelope. This amount includes all unpaid
tolls, charges, and fees currently due. Payment can also be made in person at the offices of
Linebarger Goggan Blair & Sampson, 512 S. Seventh Street, Richmond, Texas 77469 or
4828 Loop Central Drive Ste 500, Houston, Texas 77081, or you may make a payment by
credit card by calling, toll-free, 877-251-1656. Full payment must be received by the Fort
Bend County Toll Road Authority by September 6, 2022.
If payment is not made by September 6, 2022, you must attend the hearing as scheduled unless
you have posted bond at the offices of Linebarger Goggan Blair & Sampson, 512 S. Seventh
Street, Richmond, Texas 77469 or 4828 Loop Central Drive Ste 500, Houston, Texas 77081 in
the amount of $384.86 on or before the 7 day before the scheduled hearing date. The
conditions of bond must be agreed to and complied with in their entirety. The conditions of the
bond are that the you (i) will appear to answer the citation on the scheduled reset date, and (ii)
will pay the amount of any civil fine and costs assessed by the Hearing Officer, and (iii) in the
event of your failure to appear at the reset hearing, you consent to the forfeiture of the bond and
the proceeds of the bond will be applied to the amount due. You may request that the Hearing
Officer issue an order compelling the attendance of witnesses and the production of documents if
you do so in writing on or before the 7" day before your scheduled hearing date.
On your hearing date, the Hearing Officer shall examine the contents of this citation, the records
of the Fort Bend County Toll Road Authority and any evidence you may present, and issue a
decision regarding your liability as alleged by the Fort Bend County Toll Road Authority. If you
are found liable, the Hearing Officer shall determine and assess a fine of not less than $1.00 or
more than $500.00, over and above all applicable unpaid tolls, charges, fees, and court costs.
The Hearing Officer’s decision may be enforced by any or all of the following: (1)
imposition of additional fines; (2) placement of a device that prohibits movement of the
vehicle; and/or (3) vehicle registration refusal.
FURTHERMORE, you are hereby given notice that you have a right to have a court reporter
present at this hearing at your own expense. If you request to have a court reporter present at
this hearing, the Fort Bend County Toll Road Authority must receive your request in writing at
the offices of Linebarger Goggan Blair & Sampson, 512 S. Seventh Street, Richmond, Texas
77469 or 4828 Loop Central Drive Ste 500, Houston, Texas 77081 on or before the 7th day prior
to the hearing. In your request, you must submit a deposit of $150.00 to secure the services of a
court reporter. If the amount of the court reporting service exceeds the $150.00 deposit, you
will be responsible for the balance. Upon receiving a timely request for a court reporter, your
case will be reset on another docket.
