Pursuant to § 132.001 of the Texas Civil Practice and Remedies Code, Holly H. Barnes declares
as follows:
My name is Holly H. Barnes. My date of birth is February 28, 1978. My address 2118
Smith Street, Houston, Texas 77002. The facts herein are based upon my personal
knowledge, and if called upon, I could and would competently testify to them.
I am of counsel with the law firm of Meade Neese & Barr LLP. Meade Neese & Barr and
I represent Defendant 2300 River Oaks, Inc. in this matter. I submit this declaration in
support of Defendant’s Verified Emergency Motion to Continue August 8, 2023 Hearing
(“Defendant’s Motion to Continue”).
I have read Defendant’s Motion to Continue. The statements contained therein are true and
correct.
D. John Neese, Jr. is the attorney charge of this case for Defendant. He is currently out
of the country and is not scheduled to return until August 10, 2023.
I have asked Intervenor’s counsel at least four times to respond to my request to reschedule
the August 8, 2023 hearing but have not gotten a substantive response.
