ON THE 6 DAY OF September, 2021 AT 11:21 AM THE DEFENDANT,
AT 2225 COUNTY ROAD 220 MIDDLEBURG, FL 32068 WITHIN CLAY COUNTY, VIOLATED THE LAW AND DID THEN AND THERE:

Commit the offense of Driving Under the Influence of Alcohol or Drugs in violation of Florida State Statue 316.193(1)A.

On 09-06-21 at 1121, the complainant called the Sheriff`s Office to report a drunk driver. The complainant is the manager of the 7-11 at 2225 County
Road 220. The complainant said the suspect came into the store to buy beer. The complainant refused to sell the suspect beer, telling him he was too
intoxicated. The complainant said the suspect became loud and profane with her and other customers. She said the suspect went back to his vehicle and
drove eastbound on County Road 220. The complainant described the suspect as an older white male with a blonde wig on. The complainant described
PROBABLE CAUSE

the suspect`s vehicle as a blue Ford Fusion with a Florida tag of Y822QP. The complainant made a sworn written statement.

Deputy Kroh #6241 and I started to canvass County Road 220 from Highway 17. I checked the Mercury Moon and Whitey `s with no results. Deputy
Kroh checked ABC Liquors and Broudy `s Liquors. I ran the tag on the suspect vehicle and the address came back to 1723 Farm Way . I stopped in front of
1723 Farm Way but did not see the listed vehicle. I was still in front of 1723 Farm Way when approximately 60 seconds later, I saw the suspect vehicle
approaching the residence. I saw the vehicle pull into the driveway of 1723 Farm Way . The suspect was behind the wheel driving the car, there was no one
else in the car. The suspect stopped the car in the driveway of 1723 Farm Way and the suspect parked the car.

The suspect got out from the driver`s seat and approached me in his driveway and asked me "what`s going on". I explained to the suspect a complaint
had been called in from the 7-11 about him possibly being DUI. I told the suspect I would be asking him a series of questions but before that, I needed to
advise him of his constitutional warnings. I then gave the suspect his Miranda warnings using a department issued Miranda warning card. The suspect
initiallyagreed to participate with the Standardized Field SobrietyExercises.

While I was speaking with the suspect, I saw was unsteady
on his feet. He had to use one hand to prop himself up against the trunk of another car in the

driveway . His clothing was unremarkable. His hair was dark on the sides but was blonde on the top which is consistent with the description of the
person the complainant observed. The suspect had an odor of an alcoholic beverage about his person. I asked the suspect where he was coming from.
He said he went to the 7-11 but they
would not sell him alcohol. He said, "That bitch was giving me a hard time, fuck her".

I looked inside the listed vehicle without going inside the vehicle. In plain view, I observed a 4 pack of 16 ounce cans of beer, unopened, in a plastic
bag on the front passenger seat.

Post-Miranda, I asked him if he had been drinking. He said he had drank a 12 pack of beer. When asked, he said he started drinking around 0230
this morning. Later he said he woke up at 0900 and drank another 8 pack of beer starting at 0900 or 1000.

I told the suspect I would be administering a series of exercises to determine if he may
be impaired. The suspect agreed to participate.

The first exercise was the Horiz
ontal Gaze Nystagmus. The suspect exhibited nystagmus at maximum deviation in both ey es. The suspect`s pupils
were pinpoint and his ey
es were bloodshot. The suspect also exhibited ny
stagmus prior to 45 degree onset and a lack of smooth tracking in both ey
es.

The next exercise was the walk and turn. The suspect was unable to hold the start position (right foot in front of his left foot on a straight line). The
suspect started the walk and turn prior to instructions to begin. The suspect walked 10 steps none heel to toe. His steps were diagonal moving forward
on the line. The suspect turned and walked back, taking 13 steps, none of which were heel to toe. The suspect used his arms to maintain balance.

The next exercise was the One Leg Stand. After receiving instructions, he said he had no questions. The suspect then began the exercise but only
made it to 1 second before placing his foot on the ground. The suspect attempted to begin two additional times, each time not making it past 1 second.
The suspect said "I couldn`t do that sober".

The suspect refused to participate in the Romberg Alphabet exercise and the Finger to Nose exercise.

I placed the suspect in handcuffs and told him he was under arrest for DUI.
PROBABLE CAUSE

The suspect went from being compliant to being verbally aggressive and hostile. The suspect engaged in a series of profane insults from the time he
was placed in the back of the car until he was walked into the jail.

Detention Sgt Randolph #6651 gave the suspect his implied consent warnings at the booking desk. The suspect refused to participate in the breath
testing or urine collection.

The suspect was issued a citation for Driving Under the Influence of Alcohol/Drugs (refusal), citation # AEYMC8E.

The suspect was positively
identified by
me using his Florida Driver`s License.

The suspect was booked into the Clay
County
Jail without further incident.
