MOTION TO BE RELIEVED AS GUARDIAN AD LITEM Plaintiff Dora Isabel Rosales Maradiaga (“Maradiaga “) seeks to be relieved as guardian ad litem for her daughter, Plaintiff Dora Elizabeth Rosales Maradiaga (“Dora Elizabeth”). Plaintiff’s motion is unopposed. California Code of Civil Procedure, Section 372(a)(1) provides that where a minor is a party to an action, “that person shall appear either by a guardian or conservator of the estate or by a guardian ad litem appointed by the court in which the action or proceeding is pending.” “[T]he removal of a guardian ad litem . . . is a matter within the court’s control to be exercised as part of its inherent powers.” (Golin v. Allenby (2010) 190 Cal.App.4th 616, 643, citation omitted.) Plaintiff Maradiaga declares that at the time the instant action was filed, Dora Elizabeth lived with her. (Dora Isabel Decl. ¶ 3.)
