WS Zeez Nod AFFIDAVIT FOR SEARCH WARRANT dteg ~7 PH 1: 39 STATE OF OHIO ) SS LUCAS COUNTY ) TO THE SHERIFF OF LUCAS COUNTY/ TO THE CHIEF OF POLICE OF THE CITY OF TOLEDO, OHIO: Before me, ae no, Judge of the Toledo Municipal ‘Churt of the City of Toledo, Ohio/Judge of the Court of the Common Pleas, Lucas County, Ohio, the undersigned, Det. Jeffrey Sharp #2585, Toledo Police Department, Toledo, Lucas County, Ohio, and being duly sworn, deposes and says that he has reason to believe that on the person known as: Harold Glenn Tate, DOB: 07/05/1974, SSN: ***-**-8016, Black Male, 6’02”, 200 Ibs. Black hair, Brown eyes Said person currently being treated at Promedica Toledo Hospital, in the City of Toledo, Lucas County, Ohio, Who now has on, in and/or about his/her person certain item(s) of evidentiary value; to wit, the following: [1] blood sample(s), [2] hair sample(s), and/or [3] saliva sample(s)/cheek cells, the collection of which is necessary for the purpose of testing and comparing with DNA standards identified or yet remaining to be identified. The said item(s) described above ([1] blood sample(s), [2] hair sample(s), and/or [3] saliva sample(s)/cheek cells) is/are of evidentiary value to an ongoing officer involved shooting investigation originating in the state of Michigan. The facts upon which such beliefis based are as follow: Your Affiant makes this affidavit in support of an ongoing officer involved shooting investigation originating in the state of Michigan and involving Harold Glenn Tate. The facts in this affidavit were provided to your Affiant from Detective Sergeant Michael Baker of the Michigan State Police (MSP) and were gleaned from his personal observations, training, experience, and information obtained from other detectives, officers, and witnesses. 1 D/Sgt. Baker is a graduate of the 125" Michigan State Police Trooper Recruit School. He has been employed by the Michigan State Police for approximately 9 years and works as a detective sergeant for the Michigan State Police Brighton Post. D/Sgt. Baker has been involved in numerous criminal investigations throughout his career. D/Sgt. Baker was notified on 4/3/22 at approximately 0245 hrs that a deputy from the Lenawee County Sheriff's Office was involved in shooting in the City of Adrian. D/Sgt. Baker learned the following from Lenawee County Central Dispatch. Dispatch received a call of shots fired. The call was received on 4/3/22 at 0103 hrs. Dispatch recorded an original address of the incident of 440 Erie Street, Adrian MI. Dispatch call notes recorded that an unknown suspect left the scene eastbound on foot. A K9 track was initiated to locate the subject. The K9 track began after 0114 hrs by Lenawee County Sheriff K9 handler Kirk June. D/Sgt. Drewyor from the Michigan State Police discovered the next radio traffic after beginning the track was to request medical and that the suspect was in custody at 0135 hrs. D/Sgt. Drewyor contacted Captain Pifer of the Lenawee County Sheriff's Office on Erie Street. Captain Pifer stated Kirk June discharged his firearm after a K9 track and showed D/Sgt. Drewyor a vacant lot on the north side of Erie Street where the shooting occurred. The vacant lot on Erie Street is located between South Center Street and South Tecumseh Street. The vacant lot is located across from 604 Erie Street and behind 608 Frank Street. D/Lt. Darling from the Michigan State Police notified D/Sgt. Baker that the subject who was shot in the vacant lot was identified as Harold Glenn Tate. Harold Glenn Tate was transported to ProMedica Toledo Hospital for treatment. A search warrant was obtained for searching the vacant lot. A 9mm Hi-Point semi-automatic firearm was recovered from the vacant lot. The firearm was recovered within close proximity to the location where Harold Glenn Tate was located during the K9 track and shooting. 10. D/Sgt. Baker submitted a DNA swab from the recovered 9mm Hi-Point firearm to the MSP Lansing Crime Lab for DNA testing. D/Sgt. Baker knows from his training and experience that Harold Glenn Tate’s DNA is needed for comparison testing. This will be beneficial in determining if Harold Glenn Tate was in possession of the firearm. A precise method of personal identification referred to as “DNA finger-printing” exists that permits the positive identification of individuals using their genetic structure. Every individual’s sequence of DNA or Deoxyribonucleic acid molecules is unique and the specific order in which the building blocks of DNA are linked together determines the unique characteristics of a person. This process can be used to conclusively include or exclude a standard from an individual specified as compared to any sample of [1] blood, [2] hair, and/or [3] saliva/cheek cells containing DNA evidence. The sample obtained shall be maintained under the care, custody and control of the Michigan State Police until such time that it is necessary for submission to an appropriate laboratory for examination. Your Affiant has been a sworn police officer (as defined in Ohio R.C. §2935.01(B)) with the Toledo Police Department (TPD) since 2013, having been assigned as detective in the Investigative Services Bureau, Crimes against Persons Section since 2018. During my time as a detective with TPD your affiant has investigated and assisted in the prosecution of among others, criminal cases including, but not limited to: homicides, assaults, robberies, burglaries, and crimes involving the illegal possession of firearms. Further, as of 2022, your Affiant has served as a special federal officer of the United States Department of Justice (pursuant to Title 21 and Title 28 of the U.S.C., section 878) on the Northwest Ohio Violent Crimes Task Force / Safe Streets Task Force with the Federal Bureau of Investigation (FBI), Cleveland Field Office, Toledo Resident Agency. As a task force officer with the Northwest Ohio Violent Crimes Task Force / Safe Streets Task Force your affiant is authorized to investigate violations of the criminal and drug laws of the United States. During the course of my employment as a task force officer your affiant has assisted in the investigation of individuals involved in large-scale trafficking of narcotics, violations affecting interstate commerce, and the illegal possession of firearms. You are hereby commanded to search the person specified, with the necessary and proper assistance, and to obtain [1] blood sample(s), [2] hair sample(s), and/or [3] saliva sample(s)/cheek cells, within three days of this date, making the search in the Day Season.
