DEFENDANT’S DEPOSITION 13 SUBPOENAS SEEKING PLAINTIFF’S MEDICAL RECORDS 14 Background 15 Plaintiff David Sanchez (“Plaintiff”) filed this action on May 27, 2016 against Defendant 16 Worthington Ford, Inc. (“Defendant”). Plaintiff filed the operative First Amended Complaint 17 (“FAC”) on June 24, 2016. The FAC alleges that Plaintiff worked for Defendant as a 18 porter/driver from approximately September 21, 2010 until May 28, 2015. (FAC 414-16.) On or 19 about February 1, 2012, during the course of his employment, Plaintiff sustained injuries to his 20 back, neck, and spine from a car accident. (FAC 417.) Plaintiff filed a worker’s compensation 21 claim for these injuries in March 2012. (FAC 421.) The FAC alleges that Plaintiff's injuries 22 continued throughout his employment until he was wrongfully terminated by Defendant. (FAC 23 \{22-27.) The FAC asserts causes of action for (1) disability discrimination; (2) failure to «24 oH prevent discrimination; (3) violation of Labor Code §432.7; (4) wrongful termination in violation "25 of public policy; and (5) civil penalties pursuant to the Private Attorney General Act. 96 “27 28
