PLAINTIFF’S MOTION TO COMPEL VERIFIED ANSWERS TO PLAINTIFF’S
INTERROGATORIES
Plaintiff, UNIVERSITY DIAGNOSTIC INSTITUTE WINTER PARK, PLLC a/a/o Mia
Johnson, by and through the undersigned attorney, and files this Motion to Compel Verified
Answers to Plaintiff’s Interrogatories and states:
The Plaintiff served interrogatories on the Defendant.
1. This is an action for PIP benefits.
2. The Plaintiff served interrogatories on the Defendant pursuant to Florida Rule of Civil
Procedure 1.340.
3. Rule 1.340(a) requires that the interrogatories be answers fully in writing and under
oath.
4. The Defendant served answers, but they are not under oath or verified as required by
the rule.
5. Therefore, Plaintiff moves for an order of the Court requiring the Defendant to answer
interrogatories under oath.
WHEREFORE, Plaintiff respectfully requests an order from the Court granting this
motion, and any other relief the Court deems just and fair.
