I, Brielle K. Winkler, Esquire, of full age, according to law upon my oath, hereby deposes
and says as follows:
1. I am an attorney at law, licensed to practice law in the State of New Jersey, and an associate
of the law firm of Marshall Dennehey, counsel for defendants, Samantha Jo Barlond and Ace
Fa’atuai a/k/a Ace Faatuai, in the above-referenced matter.
2. This matter involves a motor vehicle accident said to have occurred on June 30, 2021. (See
police report attached as Exhibit A).
3. The relevant motor vehicle accident happened at the intersection of Wrightstown-
Cookstown Road and Bolling Boulevard on Joint Base McGuire-Dix-Lakehurst, in Burlington
County, New Jersey. (Exhibit A).

4. The vehicles involved were driven by defendants, Samantha Jo Barlond and Donna Frasier.
(Exhibit A).
5. It is alleged that plaintiff, Joselito Feliciano, was a passenger in the Frasier vehicle at the
time of the accident. (Exhibit A).
6. At present, it is upon information and belief, plaintiff is a resident of Atlantic County. (See
Complaint attached as Exhibit B).
7. Upon information and belief, defendant Frasier is a resident of Burlington County.
(Exhibit B).
8. Defendants Barlond and Fa’atuai are out of state residents, currently active Military, and
living in Las Vegas, Nevada.
9. Multiple parties are alleging injuries as a result of this accident. Defendant, Donna Frasier,
filed her own affirmative action, related to this accident on June 28, 2023. That matter was filed
in Burlington County under Docket Number BUR-L-1260-23. (See Complaint as Exhibit C).
10. The Complaint in this matter was not filed until June 29, 2023. (Exhibit B).
11. The accident relevant to this litigation occurred in Burlington County, not Atlantic County.
12. The plaintiff in the companion case, Donna Frasier, resides in Burlington County.
13. Other than plaintiff moving to Atlantic County after the accident occurred, there is no
connection to Atlantic County, and as such, venue in Burlington County would be more
appropriate.
14. Pursuant to R. 4:3-2, venue is proper where the cause of action arose or in which any party
actually resides at the time of commencement or in which the summons was served on a non-
resident defendant. R. 4:3-2(a). However, where multiple counties are joined in a single action,
venue may be laid wherever convenient. See State DEP v. Middlesex County Freeholders Board,

206 N.J. Super. 414 (Chancery Division) 1985 Aff’d. D-O-D 208 N.J. Super. 342 (App. Div.

15. Pursuant to R. 4:3-3, venue should be proper where convenient for the parties and witnesses
and in the interest of justice.
16. As the first suit relevant to this accident was filed in Burlington County, and Burlington
County is where the accident took place, Burlington County is the most convenient and relevant
forum to handle all litigation related to this accident.
17. I do note however, at this time, defendants in the Burlington County action have yet to be
served. However, once defendants are properly served in that matter, my office will be requesting
this matter be consolidated with the Burlington County matter. Accordingly, Burlington County
is the most appropriate venue to handle the eventual consolidated claims.
18. Accordingly, defendants Barlond and Fa’atuai respectfully request that venue be
transferred from Atlantic County to Burlington County, where venue is more proper.

SECTION IX. NARRATIVE (WHO, WHAT, WHEN, WHERE; HOW)
On 30 June 2021 at 0705hrs, the ECO received rtotification via radio of a motor vehicle accident at the intersection of
Wrightstown-Cookstown Road and Bolling Blvd with injuries by SSgt LORA/Police-6 and SrA SAXE/Police-6A. I, P/O
PELZER/Police-5 and SrA GOODMAN/Police-5A were dispatched along with P/Sgt HUNT/Defender-7, P/Sgt SAVILLE/Police-1,
P/O KUSHNER/Po!ice-1A. Upon arrival, LORA (Westbound traffic) and KUSHNER (Eastbound traffic) closed down the roadway
for the safety of all involved.
SAXE made contact with DRIVER-1 identified as SSgt BARLOND, Samantha who stated she was not injured and declined
medical attention. There were two juvenile passengers in BARLOND's vehicle identified as FA'TUAI, Jaxson (Male/3 years old)
and FA’TUAI, Alesena (FM/5 years old) who stated they were not injured but were examined by Plumsted Medical as a
precaution and transported to Mount Holly Pediatrics.
I made contact with DRIVER-2 identified as CIV FRAISER, Donna who stated she was not injured and declined medical
attention. PASSENGER-1 CIV BISAUPSKI, Michael stated he was not injured and declined medical attention. PASSENGER-2
CIV FELICIANO, Joselito stated he had neck and back pain at which time was assessed by medical and transported to Trenton
Trauma Center at 0748hrs, for further evaluation. His condition is unknown at the time of this report.
Investigation reveals, VEHICLE-2 (2014 Ford Van bearing NJ Reg: SG33509) was traveling westbound on Wrightstown-
Cookstown Road as they approached the traffic light at Bolling Blvd. VEHICLE-1 (2016 GMC Sierra bearing FL reg: NBDZ17)
was traveling eastbound on Wrightstown-Cookstown Road but failed to yield to oncoming traffic before turning left onto Bolling
Blvd. VEHICLE-2 attempted to brake for approximately 31ft before striking VEHICLE-1 and traveled an additional 10ft to its
controlled final rest in the middle of the intersection. VEHICLE-1 after impact traveled 300ft to its controlled final rest on Bolling
Blvd. VEHICLE-1 sustained disabling damage to the passenger side of the vehicle (front and rear doors, deployed air bags).
VEHICLE-2 sustained disabling damages to the front passenger side corner of the vehicle. See attached photographs for
specifics.
BARLOND was issued (1) DD Form 1408 violation: NJS39:4-97 Careless Driving with injury caused by accident.
The ECC made contact with Hainesport Towing who stated they would respond out to the scene. At 0827hrs,.CIV KING, Tyler/
Hainesport Towing arrived on scene and took possession of VEHiCLE-2 via DD Form 2506. 0902hrs, CIV GASKILL, Charles/
Hainesport Towing arrived on scene and took possession of VEHICLE-1 via DD Form 2506.
Amn Stewart/87 ABW/PA captured 35 pictures.
At the time of this report, no updates were available on the status of VEHICLE-2 occupants.
Scene was cleared without further incident at 0902hrs.

The relevant motor vehicle accident happened at the intersection of Wrightstown- Cookstown Road and Bolling Boulevard on Joint Base McGuire-Dix-Lakehurst, in Burlington County, New Jersey. It is alleged that plaintiff, Joselito Feliciano, was a passenger in the Frasier vehicle at the time of the accident. (Exhibit A). 6. At present, it is upon information and belief, plaintiff is a resident of Atlantic County. (See Complaint attached as Exhibit B). 7. Upon information and belief, defendant Frasier is a resident of Burlington County. (Exhibit B). 8. Defendants Barlond and Fa’atuai are out of state residents, currently active Military, and living in Las Vegas, Nevada. 9. Multiple parties are alleging injuries as a result of this accident. Defendant, Donna Frasier, filed her own affirmative action, related to this accident on June 28, 2023. That matter was filed in Burlington County under Docket Number BUR-L-1260-23. (See Complaint as Exhibit C). 10. The Complaint in this matter was not filed until June 29, 2023. (Exhibit B). 11. The accident relevant to this litigation occurred in Burlington County, not Atlantic County. 12. The plaintiff in the companion case, Donna Frasier, resides in Burlington County. 13. Other than plaintiff moving to Atlantic County after the accident occurred, there is no connection to Atlantic County, and as such, venue in Burlington County would be more appropriate. 14. Pursuant to R. 4:3-2, venue is proper where the cause of action arose or in which any party actually resides at the time of commencement or in which the summons was served on a non- resident defendant. R. 4:3-2(a). However, where multiple counties are joined in a single action, venue may be laid wherever convenient. See State DEP v. As the first suit relevant to this accident was filed in Burlington County, and Burlington County is where the accident took place, Burlington County is the most convenient and relevant forum to handle all litigation related to this accident. 17. I do note however, at this time, defendants in the Burlington County action have yet to be served. However, once defendants are properly served in that matter, my office will be requesting this matter be consolidated with the Burlington County matter. Accordingly, Burlington County is the most appropriate venue to handle the eventual consolidated claims. 18. Accordingly, defendants Barlond and Fa’atuai respectfully request that venue be transferred from Atlantic County to Burlington County, where venue is more proper. NARRATIVE (WHO, WHAT, WHEN, WHERE; HOW) On 30 June 2021 at 0705hrs, the ECO received rtotification via radio of a motor vehicle accident at the intersection of Wrightstown-Cookstown Road and Bolling Blvd with injuries by SSgt LORA/Police-6 and SrA SAXE/Police-6A. I, P/O PELZER/Police-5 and SrA GOODMAN/Police-5A were dispatched along with P/Sgt HUNT/Defender-7, P/Sgt SAVILLE/Police-1, P/O KUSHNER/Po!ice-1A. Upon arrival, LORA (Westbound traffic) and KUSHNER (Eastbound traffic) closed down the roadway for the safety of all involved. SAXE made contact with DRIVER-1 identified as SSgt BARLOND, Samantha who stated she was not injured and declined medical attention. There were two juvenile passengers in BARLOND's vehicle identified as FA'TUAI, Jaxson (Male/3 years old) and FA’TUAI, Alesena (FM/5 years old) who stated they were not injured but were examined by Plumsted Medical as a precaution and transported to Mount Holly Pediatrics. I made contact with DRIVER-2 identified as CIV FRAISER, Donna who stated she was not injured and declined medical attention. PASSENGER-1 CIV BISAUPSKI, Michael stated he was not injured and declined medical attention. PASSENGER-2 CIV FELICIANO, Joselito stated he had neck and back pain at which time was assessed by medical and transported to Trenton Trauma Center at 0748hrs, for further evaluation. His condition is unknown at the time of this report. Investigation reveals, VEHICLE-2 (2014 Ford Van bearing NJ Reg: SG33509) was traveling westbound on Wrightstown- Cookstown Road as they approached the traffic light at Bolling Blvd. VEHICLE-1 (2016 GMC Sierra bearing FL reg: NBDZ17) was traveling eastbound on Wrightstown-Cookstown Road but failed to yield to oncoming traffic before turning left onto Bolling Blvd. VEHICLE-2 attempted to brake for approximately 31ft before striking VEHICLE-1 and traveled an additional 10ft to its controlled final rest in the middle of the intersection. VEHICLE-1 after impact traveled 300ft to its controlled final rest on Bolling Blvd. VEHICLE-1 sustained disabling damage to the passenger side of the vehicle (front and rear doors, deployed air bags). VEHICLE-2 sustained disabling damages to the front passenger side corner of the vehicle. See attached photographs for specifics. BARLOND was issued (1) DD Form 1408 violation: NJS39:4-97 Careless Driving with injury caused by accident. The ECC made contact with Hainesport Towing who stated they would respond out to the scene. At 0827hrs,.CIV KING, Tyler/ Hainesport Towing arrived on scene and took possession of VEHiCLE-2 via DD Form 2506. 0902hrs, CIV GASKILL, Charles/ Hainesport Towing arrived on scene and took possession of VEHICLE-1 via DD Form 2506. Amn Stewart/87 ABW/PA captured 35 pictures. At the time of this report, no updates were available on the status of VEHICLE-2 occupants. Scene was cleared without further incident at 0902hrs.
