ANALYSIS
Motion to Compel Deposition of Person Most Knowledgeable
Defendant has objected to the deposition notice on the ground that the PMK and counsel
are not available and have not provided any available dates for this PMK deposition to take
place. Barry Decl. 2-6. Accordingly, Plaintiff is entitled to an order compelling
Defendant’s PMK deposition. The motion to compel the deposition of Defendant’s person most
knowledgeable is GRANTED.
However, Plaintiff.did not make a fact-specific showing of good cause justifying the
production of documents sought to be produced in the notice of deposition. As such,-no order
compelling production of documents will issue.
