Defendant’s Motion to Stn'ke should be summarily denied in whalc due to Defendant’s failure to meet and confer in advance ovf'filing the Motion regarding the chaflmges ta be 4 asserted herein, as required by Code 0f Civil Procedure section 435.5. Piaintiff objects tn consideration of the Case Summary and any other documents from 7 Defendant’s pending divorce action pursuant to Defendant's Request for Judicial Notice: on 3 the ground that these are irrelevant and immaterial to whether all or part of Plaintiff’s 9 Compiaint in this action is subject to a motion to strike. 10 I. n STANDARDS APPLICABLE TO MOTIONS T0 STRIKE “The court may, upon a motion made pursuant to Section 435, or at any time in. its discretioa, ‘2 and upon terms it deems proper: i3 (a) Strike out any irrelevant, faISe, or improper matter inserted in any pleading. 14 (b) Strike out an or any part of any pleading not drawn or filed in conformity with the laws of this state, a court rule, or an order of the comt" :5 (Code Civ, Pros. § 436.) . 15 “(3) The grounds for a motion to strike shall appear on the face of the challerzged pleading or 17 fiom any matter of which the court is required to take judicial notice.
