NATURE OF PROCEEDINGS: Hearing on Motion for Leave to Augment Expert Designation The Court's tentative ruling is posted online and in Court for parties/counsel to review. The matter is called for hearing and argued. After hearing oral argument, the Court adopts its tentative ruling with modifications as the Order of the Court as follows: On the Court's own motion, the Hearing on Motion to Continue Trial scheduled for 10/03/2019 is advanced to this date and heard . On October 2, 2017, Plaintiffs Saul Lopez and Adela Lopez (“Plaintiffs”) filed this action against Shant Aris Nazaryan and Razmik Nazaryan (collectively, “Defendants”) arising from a motor vehicle accident on October 3, 2015. Plaintiffs named Defendant Marine Nazaryan as a Doe defendant on June 17, 2019. On August 18, 2019, Plaintiffs filed a motion for leave to amend the complaint to add a cause of action for negligent entrustment and a claim for punitive damages. On September 4, 2019, Defendants filed a motion to continue the October 8, 2019 trial date to April 2020. On September 19, 2019, the Court denied the motion for leave to amend the complaint. Also on September 19, 2019, Plaintiffs filed an ex parte application to shorten time to hear a motion to augment Plaintiffs’ expert designation. The Court granted the ex parte application and set the hearing for October 2, 2019. The Court will also hear the motion to continue the trial on October 2, 2019. Motion to Augment Expert Designation On August 19, 2019, Plaintiffs served their expert designation but due to Plaintiff’s counsel’s inadvertence, the designation did not include Plaintiffs’ economist Jennie McNulty. On August 21, 2019, Plaintiffs’ counsel realized his mistake and immediately emailed an augmented expert Minute Order Page 1 of 3
