WHEREAS, this matter comes before the Court on the Motion to Remand filed by Plaintiff Zachary Jones (“Plaintiff”), (ECF No. 10); and WHEREAS, Plaintiff originally filed this case in the Superior Court of New Jersey, Camden County, on May 17, 2022, (Compl., ECF No. 1-1); but WHEREAS, Defendants The Chefs’ Warehouse, Inc. and The Chefs’ Warehouse Mid- Atlantic, LLC (collectively, “Moving Defendants”) removed the case to this Court on August 5, 2022, under 28 U.S.C. §§ 1332, 1441, and 1446, (ECF No. 359-1); and WHEREAS, Co-Defendants BK Specialty Foods, Inc. and Crown Equipment Corporation (“Non-Moving Defendants” and collectively with Moving Defendants, “Defendants”) appear not yet to have consented to the removal as required under 28 U.S.C. § 1446(b)(2)(A); and WHEREAS, on August 16, 2022, Plaintiff filed the present Motion to Remand on the basis of an alleged procedural defect and a lack of diversity of citizenship among the parties, (ECF No. 10); and WHEREAS, Plaintiff informed the Court by Letter on August 23, 2022, that “Defense CAM-L-001240-22 08/26/2022 Pg2of2 Trans ID: LCV20223155338 Case 1:22-cy-04929-CPO-SAK Document 13° Filed 08/24/22 Page 2 of 2 PagelD: 169 . . . counsel has had the opportunity to review the [Motion] and have consented to remand,” (ECF No. 12); and therefore IT IS HEREBY on this_24th_day of _August_, 2022, ORDERED that Plaintiff’s Motion, (ECF No. 10), is GRANTED; ORDERED this case is REMANDED to the Superior Court of New Jersey, Camden County; and it is further ORDERED that, pursuant to 28 U.S.C. § 1447(c), the Clerk of this Court shall send a copy of this Order to the Clerk of the Superior Court of New Jersey, Camden County; and it is finally ORDERED that the Clerk shail close this case.
