PLAINTIFF’S SUGGESTION OF DEATH AND
REQUEST FOR WRIT OF SCIRE FACIAS
NOW COMES Plaintiff, AMANDA FERNANDEZ IBARRA, and hereby moves this
Court to hear a Suggestion of Death and file a Writ of Scire Facias requesting that an Heir-at-Law
of the Estate of Defendant RICARDO MATA be cited and served to appear and answer herein.
1. This case arises from an auto accident that occurred on or about April 10, 2019, in
Hidalgo County, Texas wherein Plaintiff, AMANDA FERNANDEZ IBARRA, sustained personal
injuries.
2. On October 19, 2020, Plaintiff, AMANDA FERNADEZ IBARRA, filed this suit
against Defendant, RICARDO MATA, for his negligent acts and/or omissions which proximately
caused the occurrence resulting in Plaintiff’s injuries.
3. During the pendency of litigation, Plaintiff by and through undersigned counsel
discovered that Defendant RICARDO MATA died during the pendency of this litigation. See
Exhibit A: Obituary of RICARDO MATA, attached hereto and incorporated herein by reference.
4. Pursuant to Texas Rule of Civil Procedure 152, Plaintiff requests that this suit
proceed against MARIA MATA, the wife and Heir-at-Law of Defendant RICARDO MATA.
5. Plaintiff further request that the clerk of this Court issue a Writ of Scire Facias for
MARIA MATA, Heir-at-Law of Defendant RICARDO MATA, who may be found at 5300 N. 45th
Street, McAllen, TX 78504, and requiring her to appear and defend this suit.

WHEREFORE PREMISES CONSIDERED, Plaintiff prays that the Court direct the
District Clerk to issue a Writ of Scire Facias for MARIA MATA, Heir-at-Law of Defendant
RICARO MATA, who may be found at 5300 N. 45th Street, McAllen, TX 78504, to appear and
defend this suit.

April 13, 1953
Ricardo Mata, Sr., 69, entered eternal rest on Friday May 27, 2022 at his
residence in McAllen. He was born on Monday April 13, 1953 in McAllen,
Texas, the son of Manuel and Beatriz (Castillo) Mata. He is preceded in
death by his parents, Manuel Mata in 2016 and Beatriz Mata in 2009; and
by his brother, Roel Mata in 1981.
He is survived by his wife: Maria Mata of McAllen; son: Ricardo Mata, Jr.
of McAllen; daughter: Marie Michelle (Mata) Rodriguez (Johnny
Rodriguez) of McAllen; grandchildren: Ricardo (Stephanie) Mata, III,
Alexis Dominique Mata, Andrea Danielle Mata, Karis Rose Mata,
Alejandro Elias Mata, Felipe Cristian Garza, Johnny Rodriguez, Jr.,
Victoria Marie Rodriguez, and Jozlin Jisselle Rodriguez; siblings: Roberto
(irma) Mata of McAllen, Ruben (Linda') Mata of McAllen, Rosa (Cesar)
Gomez of McAllen, Rogelio (Hortencia) Mata of McAllen, Ramiro
(Patricia) Mata of McAllen, Rolando (Patty) Mata of McAllen and Manuel
Mata, III of McAllen.
Visitation will be held from 3:00 to 9:00 PM Monday, May 30, 2021 with
the Holy Rosary being recited at 7:00 pm at Rivera Funeral Home of
McAllen. Visitation on Tuesday, May 31, 2021 will be from 6:00 pm to
9:00 pm with the Holy Rosary being recited at 7:00 pm at Our Lady of
Perpetual Help Catholic Church, 2209 Kendlewood Ave., McAllen.
Celebration of Life Mass will be said at 1:30 pm Wednesday, June 1,
2022 at Our Lady of Perpetual Help Catholic Church in McAllen.
Interment will follow at Valley Memorial Gardens in Mission.
Serving as pallbearers will be: Ricardo Mata, Jr., Ramiro Mata, Ricardo
Mata, III, Alejandro Mata, Felipe Garza and Manuel Mata, III. Honorary
pallbearers will be Ruben Mata, Roberto Mata, Rogelio Mata, Rolando
Mata and Johnny Rodriguez.
Service arrangements have been entrusted to the care of Rivera Funeral
Home of McAllen.
