Dear Justice Bergmann:

       This office represents the Petitioner Village Green at Sayville, LLC (“Petitioner”) in the
above-captioned matter. I am writing to request that the return date of the Petition in the
foregoing matter, currently April 18, 2023, be adjourned pending a determination of Petitioner’s
motion pursuant to CPLR § 3217(b) to discontinue without prejudice the seventh and eighth
causes of action in the Amended Petition, dated July 18, 2017.

        Pursuant to CPLR § 3217, discontinuance of the aforementioned causes of action may be
achieved by either a stipulation of the parties (CPLR § 3217(a)(2)) or an order of the Court
