     Department 514 of the above-entitled Court, located at 400 McAllister Street, San Francisco, CA 94102,
23   Plaintiff Eleanor Young, will, and hereby does, apply ex parte to this Court to amend the Interlocutory
24   Judgment entered on November 26, 2019 .
25           Defendant makes this application pursuant to Code. Civ. Proc.     tits   2025.410-2025.450 and Cal.
     Rules of Court Rule 3.1300 as appointed referee Tim Johnson is unable to act as referee due to the fact
27   that his company's Errors and Omissions coverage will not allow him to serve as partition referee.
28           This motion is based on this notice, the attached memorandum of points and authorities, the

      declaration of Robert L. Mezzetti II filed concurrently herewith, the record and all pleadings and papers
      on file in this action, any relevant matters that are judicially noticeable, and such other and further
      argument or evidence as may be presented to the Court at or before the hearing hereof.
              Cal. Rule of Court ("CRC"), rule 3.1201(b) requires the parties to indicate whether any similar

     ex parte applications have been refused in whole or in part. There have been no such prior applications.
