The Court reads the Ex Parte Application in chambers and rules as follows: Plaintiff’s Ex Parte Application For Order Setting Hearing On Application For Sale is DENIED, without prejudice. The Court finds that notice was not properly given to the Judgment Debtors/Defendants Guarav xxxxxxxxxx and xxxxxx xxxxxxx. (Cal. Rules of Court(CRC), rules 3.1203 and 3.1204). As the Court has emphasized on more than one occasion (see e.g., Minute Order filed 8/12/2021), to date, Robert J. Liskey, Esq. has not filed and served a Substitution of Attorney in this matter. Therefore, he is not counsel of record for the Judgment Debtors/Defendants in this action. Hence, they are currently self-represented litigants. The order granting the motion to relieve their prior counsel was entered on July 30, 2020. Accordingly, notice of this ex parte application must be given to the individual judgment debtors/defendants directly and not through Mr. Liskey; he is not “Judgment Debtors’ Counsel” in this matter, as stated in the notice of ex parte application itself. The Court will also note that the application fails to state whether the opposing parties were intending to appear to oppose the application, as required under CRC, rule 3.1204.
