                       PLEASE TAKE NOTICE that Petitioner, counsel Rosemary Ward, hereby moves this Honorable

          Court by way of this ex parte application that is being brought because of the exigent circumstances.

          I.           FACTS RELATED TO EXIGENT CIRCUMSTANCES

                       There has been a breakdown in the attorney client relationship and Ward should be relieved as counsel.

          The Reply is due on 2/28/19 and the hearing is set for 3/8/19. These matters should be continued. (Declaration

          -0fRoseroary Ward filed concurrently). If the court will not relieve Ward ex parte she can the file a noticed

          motion to be relieved as counsel once tile continuance is granted.

 24 Vll.               LEGAL BASIS FOR EX PARTE APPLICATION
 25         This Ex Parte Application should be granted pursuant to California Rules of Court, Rule 3.1201 et
    seq. provides in relevant part as follows:
 26                "A request for ex parte relief must be in writing and must include all of the following:
                   (1) An application containing the case caption and stating the relief requested;
 27                (2) A declaration in support of the application making the factual showing required under rule
                   3.1202 ( c);
 28                (3) A declaration based on personal knowledge of the notice given under rule 3.1204;
                   (4) A memorandum; and
