14 1. Facts and Relevant Procedural History
15 Plaintiff Michael Ryan (“plaintiff”) filed this action on 3/25/19 against defendants Lattie,
16 Malanga, & Libertino, LLP, Gerald Malanga, and Teresa Libertino (collectively “defendants”)
17 for breach of an oral contract, wherein plaintiff, an attorney, was to provide legal services for
defendants.

19 The complaint alleges causes of action for breach of contract and quantum meruit/unjust
20 enrichment against defendants.
21 Plaintiff served written discovery consisting of demands for production, special
22 interrogatories, and form interrogatories on defendants on 6/5/19. (Monarch Decl., ‘][4.) Responses
23 were due 7/10/19. (Id. at ‘][5.) None of the defendants requested an extension. (lbia'.) On 7/ 16/ 19,
24 plaintiff sent a letter to defendants stating no responses had been received, no extension granted,
25 and therefore all objections were waived. (Wakefield Decl., ‘][6.) The letter requested responses
26 from defendants by 7/26/19, without objections, and that if no responses were received, plaintiff
27 would file motions to compel. (Ibid.)
