Superior ILED County OF of California APR 05 2021 Sherri R. ¢, ees By Cet/Clerke SUPERIOR COURT OF THE STATE OF CALIFORNIA FOR THE COUNTY OF LOS ANGELES 10 11 CASE NO. 19BBCV00330 12 ALICE JUNE DAVIDSON, 13 Plaintiff, 14 v ORDER DENYING MOTION TO 15 ANDREA LIN, et al, RECUSE & STRIKING STATEMENT OF 16 Defendants DISQUALIFICATION 17 18 This case was filed on April 16, 2019, and from the date of filing it has been assigned to 19 Judge John L. Kralik, the undersigned, for all purposes. 20 On March 30, 2021 Defendant Andrea Lin filed a Notice of Motion and Motion for 21 Recusal of Judge Kralik, which the court treats as a verified statement of disqualification for 22 cause filed pursuant to Code of Civil Procedure 170.3(c)(1). The grounds for disqualification are 23 defendant’s opinion and speculation, the court’s comments upon the factual and legal issues in 24 the case and on the credibility of witnesses, and a contention that the court’s rulings have all 25 been against defendant, are incorrect and not based upon controlling law, and are unfair. None 26 of the rulings are supported by orders; none of the alleged comments are set forth in haec verba 9a 27 or supported by transcripts but are summarized and presented as a matter of perspective.
