Seq. 002) and plaintiff having provided proof of plaintiff's age (NYSCEF Doc. No. 85);
WHEREAS defendant Temple Emanuel filed a Motion for Summary Judgment on May
27, 2020 with a return date of June 26, 2020;
WHEREAS the Court having conducted a remote conference with all parties on June 3,
2020 and with good cause shown;
IT IS HEREBY ORDERED, STIPULATED AND AGREED, by and between counsel
for the parties herein as follows:
1. Plaintiff's motion for Special Preference (Mot. Seq. 002) is granted; and
2, Defendant Temple Emanuel’s motion for Summary Judgment (Mot. Seq. 003) returnable
on June 26, 2020 is adjourned to September 24, 2020. Opposition to defendant’s motion
shall be filed by September 8, 2020 and any Reply shall be filed by September 23, 2020;
and
3. Should this matter be called or scheduled for trial prior to a decision having been issued
on defendant’s summary judgment motion, any such trial shall be stayed until such time
as the Court issues its decision on defendant’s motion (Mot. Seq. 003).Digital, faxed, electronic and/or scanned signatures herein will be deemed as effective
