NO.: (X06) UWY-CV21-5028294-S : SUPERIOR COURT NANCY BURTON : COMPLEX LITIGATION DOCKET v. : AT WATERBURY DAVID PHILIP MASON, ET AL : APRIL 13, 2023 OBJECTION TO PLAINTIFF’S MOTION FOR STAY (#431.00) The defendants, Elinore Carmody and Dennis Gibbons, hereby object to the plaintiff’s motion for stay filed on April 12, 2023 [Dkt. #431.00]. The plaintiff’s motion seeks an order that the case be stayed “through May 1, 2023”. If the motion to stay is granted, the defendant, Elinore Carmody, will be precluded from filing a motion for summary judgment as to the remaining count against her in the fifth amended complaint (Count Two), which alleges defamation. Under the current scheduling order [Dkt. #284.00], the deadline for filing dispositive motions is May 1, 2023. While the Redding defendants recently filed a motion to modify the current scheduling order [see Dkt. #418.00], that motion has not been ruled upon, and Ms. Burton has until April 19, 2023, to file her objection. Therefore, barring an extension of the dispositive motion deadline, the defendant intends to file her motion for summary judgment by the current deadline of May 1, 2023.
