exhibits thereto, and the accompanying memorandum of law, all dated April 24, 2023, and all
prior pleadings and proceedings herein, Plaintiff Barry Yampol will move this Court, the
Supreme Court, County of Nassau, IAS Part 26, at the Nassau County Courthouse located at 100
Supreme Court Drive, Mineola, New York, on May 12, 2023, at 9:30 a.m., or as soon thereafter
as counsel can be heard, for an order: (1) ordering Defendants to comply with N.Y. Ins. Law
§ 1213(c)(1) by depositing cash, bond, or security of at least $48,638,627.10 with the clerk of
court; and (2) holding Defendants’ motion to dismiss, NYSCEF 13, in abeyance until said
compliance.
