In connection with he above action, Plaintiff CIG, LLC hereby withdraws its Motion to
Compel discovery, filed on March 14, 2023, under NYSCEF Dkt. Nos. 144-152. Counsel for
Defendant has recently provided us with Bates Nos. LBC9200-9391 on May 24, 2023.
Therefore, we respectfully request Motion Sequence #5 be withdrawn and marked off the
calendar.
In addition, this letter serves as notice of Plaintiff's intent to file a Summary Judgment
motion in this action.
