                  PLEASE TAKE NOTICE that upon the annexed affirmation of ANDREW R.

          DIAMOND, ESQ., with exhibits annexed hereto, and all pleadings heretofore had herein, the

          plaintiff will move this Court at the Motion Support Office, Room 130, hereof, to be held at the

          Courthouse located at 60 Center Street, New York, New York, on the 15th day of JUNE, 2021

          at 9:30 a.m. in the forenoon of that day or as soon thereafter as counsel can be heard, for an order

          pursuant CPLR 1015(a) and 1021 lifting the automatic stay following the death of the

          plaintiff/decedent, KEVIN MCGONIGAL; changing the caption to reflect the appointment of

          Michelle Lynn Devita, as Administratrix of the Estate of KEVIN MCGONIGAL, deceased; and

          restoring this case to “active status” so that the appeal filed by plaintiff’s counsel may be heard

          and decided and for such other and further relief that this court may deem just and proper.

                  This is an action for personal injury.

                  An affirmation that a good faith effort has been made to resolve the issues raised in this

          motion is annexed hereto.

                  PLEASE TAKE NOTICE, that pursuant to CPLR 2214(b), all answering papers, if any, are

          required to be served upon the undersigned no later than seven (7) days before the return date herein.
