STIPULATION RE PLAINTIFF MICHAEL MONTANO’S CLAIM RELATED TO EMOTIONAL DISTRESS
1 TO ALL PARTIES AND THEIR ATTORNEYS OF RECORD HEREIN:
2 IT IS HEREBY STIPULATED, between Plaintiff Michael Montano and all Defendants in this
3 matter, through their respective counsel of record herein, as follows:
4 1. That Plaintiff Michael Montano will be making a claim for physical pain, mental suffering,
5 emotional distress usually associated with physical injuries claimed in this lawsuit, and other non-
6 economic damages as will be proven at the time of trial by lay witness testimony;
7 2. That Plaintiff Michael Montano is not making a claim for any diagnosed mental condition
8 including but not limited to anxiety, severe emotional distress, PTSD, or any other psychological
9 or psychiatric condition;
10 3. Plaintiff Michael Montano will not designate or call any psychological or psychiatric expert to
11 testify as to any psychological or psychiatric condition in this lawsuit, but in the event Defendants
12 call any expert to testify as to any psychological or psychiatric condition in this lawsuit, Plaintiff
13 reserves the right to counter designate any expert;
14 4. That this stipulation is not admissible at trial and no reference to this stipulation will be made at
15 the time of trial unless it is necessary to enforce this stipulation; and
16 5. That Defendants Ngochao Thi Nguyen, City of Salinas, and Gino’s Restaurant, Inc., will
17 withdraw their pending Motion to Compel Deposition Testimony of Michael Montano and
18 request for sanctions.
