That Plaintiff Michael Montano is not making a claim for any diagnosed mental condition 8 including but not limited to anxiety, severe emotional distress, PTSD, or any other psychological 9 or psychiatric condition; 10 3. Plaintiff Michael Montano will not designate or call any psychological or psychiatric expert to 11 testify as to any psychological or psychiatric condition in this lawsuit, but in the event Defendants 12 call any expert to testify as to any psychological or psychiatric condition in this lawsuit, Plaintiff 13 reserves the right to counter designate any expert; 14 4. That this stipulation is not admissible at trial and no reference to this stipulation will be made at 15 the time of trial unless it is necessary to enforce this stipulation; and 16 5.
